Terms of Service

NextSell Agency is a software-as-a-service platform for agencies that manage OnlyFans creator accounts. It includes:

• A messaging centre with AI-generated suggestions and, if you enable them, automated replies.
• Management of several creator accounts from a single workspace.
• Automations triggered by fan activity and PPV script sequences.
• Analytics and earnings dashboards.
• Media vault management.
• Team management with roles (owner, chatter and viewer).

The Service is offered exclusively to businesses and professionals. It is not intended for consumers.

To use the Service you must:

• Be at least 18 years old.
• Act on behalf of a business and have the authority to bind it to these Terms.
• Have the creator's authorisation to manage each OnlyFans account you connect, either as its owner or as an agency acting on their behalf.
• Not be barred from using the Service under applicable law.

• Security — you are responsible for keeping your credentials confidential and for all activity in your workspace.
• Team — you decide who joins your workspace and with which role, and you are responsible for their use of the Service.
• Connected accounts — OnlyFans accounts are connected through our integration provider, OnlyFansAPI.com. You confirm that you are entitled to grant that access.
• Accurate information — the information you provide must be true and kept up to date.
• If you suspect unauthorised access, tell us immediately at legal@nextsell.ai.

4.1 Subscription model

The subscription is priced per OnlyFans account (“seat”), plus a fixed platform fee. The number of seats you buy limits how many OnlyFans accounts can be connected at the same time; an account that is disconnected or in error still occupies its seat until you remove it. Without an active subscription you cannot connect accounts or use the paid features.

Current prices, the currency and the available billing intervals (monthly or annual) are shown on the Billing page and in the checkout before you pay. Prices exclude taxes.

4.2 Changing seats or billing interval

• Adding seats applies immediately, and you are charged the prorated difference for the rest of the current period.
• Removing seats is scheduled for your next renewal; it is neither charged nor refunded, and until then you keep the seats you paid for.
• Switching from monthly to annual applies immediately; switching from annual to monthly applies at the end of the annual period already paid.

4.3 Commission on AI-generated sales

The Billing page shows the commission rate that applies to revenue attributable to the Service's AI features. Any commission is invoiced separately and only after prior notice.

4.4 Renewal and payment

Subscriptions renew automatically at the end of each period until cancelled, and you authorise us to charge the payment method on file through Stripe. If a payment fails, Stripe will retry it; if it remains unpaid we may restrict or suspend the Service until the balance is settled.

4.5 Cancellation

The workspace owner can cancel at any time from the Billing page, through the Stripe customer portal. The cancellation takes effect at the end of the current period, and you keep access until then.

4.6 Refunds

Amounts paid are non-refundable, except where the law requires otherwise. We may, at our discretion, offer credits or refunds for billing errors or significant service outages; write to legal@nextsell.ai.

4.7 Taxes

Prices exclude VAT and other taxes. Applicable taxes are calculated at checkout from your billing address, and you can provide your VAT number so it appears on your invoices.

You agree not to:

• Use the Service to distribute illegal content or content that infringes third-party rights.
• Send spam or unsolicited bulk messages, or harass fans or anyone else.
• Circumvent rate limits, usage limits or subscription restrictions.
• Reverse-engineer the Service or attempt to extract its source code.
• Resell the Service or offer it as a white-label or competing product without our written consent.
• Use the Service in breach of the OnlyFans Terms of Service or community guidelines.
• Introduce malware or attempt to access other workspaces or their data.

We may suspend or close workspaces that breach this section.

The Service generates suggestions and replies with artificial intelligence. You acknowledge that:

• Outputs are not guaranteed — they may be inaccurate, inappropriate or incomplete.
• You control the level of automation — suggestions only, approval before sending or automatic sending — for each creator account and fan.
• You are responsible for the messages sent from your connected accounts, whether written by a person, by an automation or by the AI. If you enable automatic replies, you accept responsibility for messages sent without manual review.
• The AI does not replace your judgement — it is a tool to assist your team.

• No affiliation — NextSell Agency is not affiliated with, endorsed by or connected to OnlyFans or its operator, Fenix International Limited.
• Third-party provider — the connection works through OnlyFansAPI.com, an independent provider. Changes to OnlyFans or to that provider may affect or interrupt the Service, and we are not liable for those disruptions.
• Platform rules — you are responsible for using the Service in compliance with the OnlyFans terms.

Our Privacy Policy explains how we process personal data and forms part of these Terms. For the creator and fan data you bring into the Service, we act as your processor and process it only to provide the Service; you are responsible for having a legal basis and for informing those people. If you need a data processing agreement, write to privacy@nextsell.ai.

The Service, its software and its content belong to NextSell Agency and are protected by intellectual property law. You keep all rights to your content and data, and you grant us a limited licence to process them solely to provide the Service.

We work to keep the Service available, but we do not guarantee that it will be uninterrupted or error-free. We may carry out maintenance and change or discontinue features; we will give reasonable notice of changes that materially reduce the Service.

To the maximum extent permitted by law:

• The Service is provided “as is” and “as available”, without warranties of any kind.
• We are not liable for loss of revenue, profits, subscribers or fans, for damage to the standing of your OnlyFans accounts, or for indirect, incidental or consequential damages.
• Our total liability for any claim is limited to the amounts you paid us in the 3 months before the event giving rise to it.

You will indemnify and hold harmless NextSell Agency and its team against claims, damages and costs (including reasonable legal fees) arising from your use of the Service, the content sent from your connected accounts, or your breach of these Terms or of third-party rights.

• By you — you can stop using the Service and delete your account at any time from Account Settings. Deleting the last account in a workspace deletes the workspace and cancels its subscription.
• By us — we may suspend or terminate access if you breach these Terms, fail to pay, or act in a way that harms other users, third parties or the Service.
• Sections 6, 9, 11, 12 and 14 survive termination.

We may update these Terms. We will notify material changes by email at least 14 days before they take effect. If you continue to use the Service after that date, you accept the new Terms; if you do not accept them, you can cancel before then.
